Article 1 - Purpose

The present terms and conditions govern the sales by Oliviers & Co SA, with a capital of €2,047,387.00, headquartered at ZONE ARTISANALE DE PITAUGIER, 04300 MANE, of Products.

 

Article 2 - Price

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other applicable taxes at the time of the order), unless otherwise stated, and excluding processing and shipping fees.

For orders to countries other than mainland France, you are the importer of the relevant product(s). Customs duties or other local taxes, import duties, or state taxes may apply. These duties and fees are not the responsibility of Oliviers & Co SA. They will be at your expense and are your full responsibility, including declarations and payments to the competent authorities and organizations in your country. We recommend that you check these matters with your local authorities.

All orders, regardless of their origin, must be paid in euros.

Oliviers & Co SA reserves the right to change its prices at any time, but the product will be billed based on the price in effect at the time of order confirmation and subject to availability.

The products remain the property of Oliviers & Co SA until full payment of the price is received.

Note: Once you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

 

Article 3 - Orders

Oliviers & Co reserves the right not to process a payment or confirm an order for any reason, particularly in case of supply issues or difficulties related to the received order.

 

Article 4 - Validation of your order

Any order placed on the www.oliviers-co.com website implies acceptance of these General Terms and Conditions. Order confirmation will signify your full acceptance of these terms and conditions, without exception or reservation.

All data provided and the recorded confirmation will serve as proof of the transaction.

You declare that you are fully aware of this.

Order confirmation will act as a signature and acceptance of the transactions carried out.

A summary of your order information and these General Terms and Conditions will be sent to you via the confirmation email of your order.

 

Article 5 - Payment

By validating your order, you are obligated to pay the indicated price.

You can pay by credit card, PayPal, or bank transfer.

Payment by credit card and PayPal: The transaction and payment are secured (SSL 3DSecure). Please note that your payment card will be debited when you confirm payment through the secure payment center (PayPal/Paybox), which will send you a payment confirmation email.

Payment by bank transfer: Bank details are provided when placing the order. The order will only be shipped once funds are received in Oliviers & Co's bank account. Oliviers & Co reserves the right to cancel an order if the funds are not received within 10 business days. Bank transfer payments do not block product stock. If a product is unavailable when payment is received, Oliviers & Co may either replace the product with an equivalent or refund the value of the missing product.

 

Article 6 - Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without justification or penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, you are responsible for the product's condition. Any damage to the product at this stage may invalidate the right of withdrawal.

Return shipping costs are free: they will be refunded upon request, by bank transfer to your credit card for card payments or by bank transfer for check or PayPal payments (in this case, please include a bank statement with your request).

In the event of exercising the right of withdrawal, Oliviers & Co will refund the amounts paid within 14 days of receiving your request, using the same payment method as the one used during the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

According to the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  • The provision of services fully performed before the end of the withdrawal period, and whose execution began after the consumer's prior express consent and express waiver of the right of withdrawal.
  • The provision of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional, and which may occur during the withdrawal period.
  • The provision of goods made to the consumer's specifications or clearly personalized.
  • The provision of goods that are liable to deteriorate or expire rapidly.
  • The provision of goods that have been unsealed by the consumer after delivery and cannot be returned for health or hygiene reasons.

  • The provision of audio or video recordings or computer software that have been unsealed by the consumer after delivery.
  • The provision of a newspaper, periodical, or magazine, except for subscription contracts to these publications.
  • Transactions concluded during a public auction.
  • The provision of digital content not supplied on a physical medium, whose execution began after the consumer's prior express consent and express waiver of the right of withdrawal.

 

Article 7 - Availability

Our products are available as long as they are visible on the www.oliviers-co.com website and subject to availability. For out-of-stock items, our offers are valid subject to availability from our suppliers.

If a product is unavailable after you place your order, we will inform you by email. Your order will be automatically canceled, and no charge will be made to your account.

Additionally, the www.oliviers-co.com website is not intended to sell products in large quantities. Therefore, Oliviers & Co SA reserves the right to refuse orders of more than 100 identical items.

 

Article 8 - Delivery

The products are delivered to the delivery address provided during the order, with an average delivery time of 2 working days from the shipment and when the carrier takes charge of the package, with a maximum delivery time of 10 working days.

If there is a shipping delay, an email will be sent to inform you of any potential impact on the estimated delivery time.

In accordance with legal provisions, in case of shipping delay (beyond the 10 business days mentioned above), you have the option to cancel the order under the conditions specified in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will proceed with a refund, including shipping costs, as outlined in Article L 138-3 of the Consumer Code.

In case of delivery by a carrier, Oliviers & Co SA cannot be held responsible for delivery delays caused exclusively by the customer's unavailability after multiple appointment proposals.

Delivery by La Poste "So Colissimo suivi":
When the order is placed online, you will receive an automatic email confirming the shipment of your order.

- For France, the package is delivered against signature, and if absent, it is left at the nearest post office.

- For Europe1, 2, 3, and 4 zones, the transport is carried out based on agreements between La Poste and their local service providers. The package is delivered against signature.

Express delivery by Chronopost (Metropolitan France only, excluding Corsica and Monaco):

An order placed before 11am working day will be delivered the next day before 1pm (except for the period between 20th and 24th December, the guarantee before 1pm is not guaranteed but the product will be delivered the next day), on working days only.
We offer two express delivery services:
i/Chrono 13 for home delivery (or to the address of your choice),
ii/Relay 13 for relay point delivery.

The buyer is required to check the condition of the packaging and the compliance of the delivered products as soon as the package is handed over. Delivery issues:

Any claim for non-compliance of the delivered products (missing item, incorrect product, damaged product) must be notified by the buyer to the carrier and in writing within 72 hours to the following address: [email protected].
Any claim for visible defects of the delivered products must be notified by the buyer in writing within 8 days of receipt to the following address: [email protected].

The buyer must provide Oliviers & Co with any necessary evidence for the claim, including photos.
If the claim is accepted, the buyer may benefit from the refund or exchange conditions outlined below.
If no claim is made within the aforementioned time limits, the products will be deemed compliant and accepted by the buyer.

 

Article 9 - Warranty

All our products are covered by the legal warranty of conformity and the warranty against hidden defects, as provided in Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned, exchanged, or refunded.

All claims, requests for exchange or refund must be made by email within 30 days of delivery.

Products must be returned in the condition in which you received them, with all elements (accessories, packaging, instructions, etc.). Shipping costs will be refunded based on the amount charged, and return shipping costs will be refunded upon presentation of proof by bank transfer to your credit card for credit card payments or by bank transfer for check or PayPal payments (in this case, please include a bank statement with your request).

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

 

Article 10 - Liability

The products offered comply with current French legislation. The liability of Oliviers & Co SA cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities for importing or using the products or services you wish to order.

Furthermore, Oliviers & Co SA cannot be held responsible for damages resulting from improper use of the purchased product.

Finally, the liability of Oliviers & Co SA cannot be engaged for any inconvenience or damage inherent in the use of the internet, such as service interruptions, external intrusion, or the presence of computer viruses.

In case of damages:

Please note your reservations on the carrier’s documents or refuse the delivery, and inform us by mail. This procedure is mandatory for the item ordered to be exchanged or refunded, as well as the return shipping costs as soon as possible. We insure the goods until the delivery location but cannot be held responsible for an inability to deliver due to reasons beyond our control (absence, address error, etc.), so please ensure the accuracy of delivery addresses. Any address errors or inaccuracies may result in significant delays and additional costs, which will be passed on to you. Any delay due to force majeure (strikes, bad weather, etc.) will not engage the responsibility of Oliviers & Co.

 

Article 11 - Applicable Law in Case of Disputes

The sales contract is governed by French law. Any disputes related to the interpretation or non-performance of this contract will fall under the jurisdiction of the court in the defendant's place of residence, the court of the place of actual delivery, or the court of the location where the service was performed.

 

Article 12 - Intellectual Property

All elements of the website www.oliviers-co.com are and remain the intellectual and exclusive property of Oliviers & Co SA. No one is authorized to reproduce, exploit, redistribute, or use, in any way, even partially, elements of the site, whether they are software, visual, or audio. The computerized records of Oliviers & Co. SA will be considered by all concerned parties as proof of communications, orders, payments, and transactions between the parties.
